What are the evaluation criteria?
The study of a specific case, a divorce case, implies determining the reasons and ways of initiating the divorce proceedings. The Family Law regulates two ways of initiating proceedings for divorce:
- When both spouses agree to divorce and when they have submitted an agreement regarding the exercise of parental rights and duties and for the support and upbringing of the children. Spouses, personally or through their lawyer, submit a joint proposal for an amicable divorce to the court. The court summons them to a hearing where, if it clearly determines that the spouses made such mutual consent freely, seriously and unwaveringly, it makes a decision to divorce the marriage by agreement;
- When there is no mutual consent for divorce, a lawsuit is filed by one of the spouses. The Family Law recognizes two categories of grounds for which a marriage may be dissolved by way of a lawsuit.
- The first is because the marital relations between the spouses are disturbed to such an extent that the common life has become unbearable,
- The second reason is that there has been a de facto break in the marital union for more than 1 year.
The specifics of the divorce litigation will be in the focus of interest of high school students, starting with an assessment of the reasons and the way of initiating the procedure, preparation of appropriate acts, introductory speeches, evidentiary procedure (proving the personal and property circumstances of the spouses, as well as their income and the possibility of earning, which is an important factor for determining the way of keeping, entrusting and supporting the children, determining the mutual relations of the spouses, as well as the specifics in the procedure for dividing the property that the spouses acquired during the marriage), final words and judgment. The assessment will take place on two levels: assessment of the written part (formal) and the oral presentation, i.e. simulation (oratory skills). The commitment, ambition and responsibility of each high school student will be assessed individually, and the solving of tasks and the decision-making process through the presentation of the completed part of the divorce procedure (courtroom) will be assessed as a team.
